CONDITIONS OF SALE
This document summarizes the sales conditions that are hereby applied relative to the purchase of products through the e-commerce site www.motoutlet.it by persons hereby defined as Customers.

Alesia srl reserves the right to vary the terms of these conditions.
Eventual modifications shall be considered valid at the time of publication to this site.
ACCEPTANCE OF SALES TERMS
The contract between Alesia srl and the customer must the client shall be considered concluded upon the acceptance, even partially, of the order on behalf of Alesia srl, which shall reserve the right to accept the order. Acceptance is considered tacit, if not otherwise communicated in some way by the customer. By placing an order in the ways provided, the customer shall declare that he has reviewed all of the indications provided during the purchase process and fully accepts the general and payment conditions outlined below. Any right of the customer to damages of compensation, as well as any contractual on non-contractual liability for direct or indirect damages to persons and/or property, caused by the non-acceptance, even partially, of an order, shall herby be excluded
METHODS OF PURCHASE
The customer may only purchase products on the Motoutlet.it site when the order is placed as described in the relevant information sheets. The Customer’s order shall be completed by sending the order through the motoutlet.it website and the contextual receipt of the confirmation email to the e-mail address provided by the customer. The confirmation email shows the date and time of receipt of the order and the sales order number, as well as all the personal data entered by the customers who agree to verify the correctness and to provide any corrections in a timely manner. Once the online purchase process has been completed, the customer shall print or save an electronic copy and continue to maintain the general terms of sale, in accordance with the D.Lgs 206/05 (consumption code). In the event of non-acceptance of an order, Alesia srl shall contact the customer in a timely manner. Value Added Tax is included in the price of the freight charges and any discounts related to any promotion codes. Alesia srl reserves the right to adjust prices at any time and without warning.
Use of the MOTOUTLET gift Card
The gift Card is valid for a period of one year from the date of issue.
The Gift Card may also be used in part: the difference may be used with another Gift Card.
The Gift Card may only be used to purchase goods for sale on the website or in the store and may not be converted into cash or be used for the purchase of other Gift Cards.
It is possible to purchase items that have a value greater than that of the Gift Card, paying the difference for the completion of the order with a payment method among those that are listed.
The right of withdrawal is guaranteed to the recipient of the Gift Card if it is used under the terms of the law. Gift cards may be combined with all other discounts on the website and in the store, and with other Gift Cards.
Paypal – Credit Card.
Purchases may be made through a Paypal account or by credit card with Paypal protection.
Items may be paid for by Bank Transfer at a branch of a bank or through their website, indicating the reference number and the date of the order, within seven days of the order.
Upon receipt of the transfer, Alesia srl shall complete the order. If this method is chosen, the order confirmation shall show the transfer details necessary to complete the order (IBAN coordinates).
Paypal – Credit Card
Purchases may be made through a Paypal account or by credit card with Paypal protection. In the event the an order is cancelled, or the customer exercises the right to withdraw from the order, the amount shall be refunded to the customer’s Paypal account, withholding the relevant 4% service fee charged by Paypal to Alesia srl.
CASH ON DELIVERY (C.O.D.)
Purchases may be made by paying cash upon delivery to the courier. This payment method is valid only for orders that have a maximum value of 250 euros.
For orders higher than 250 euros, the payment may only be made with Paypal Credit Card or Bank transfer. There is an additional cost of 5 euros for Cash On Delivery service.
THE C.O.D. charges shall be made known at the time of the order.
DELIVERY METHODS IN ITALY
Normally orders are delivered to the courier within 24 hours if the merchandise is in stock. If the merchandise is not in stock, the customer shall be informed when the merchandise shall be available.
Alesia srl ships orders Monday through Friday using GLS Express Courier which has an average delivery time of 24 to 48 hours.
Alesia srl shall inform the customer of the shipping number in order to track the package on the GLS site. Package tracking is available starting at 8:00 p.m. on the day of shipment. Delivery times may vary due to force majeure, or road traffic conditions. Standard delivery normally occurs from 9 a.m. to 1 p.m. and from 2 p.m. to 6 p.m. daily, non-holidays, Monday to Friday. The courier shall make the first delivery without notice. In the customer’s absence, the courier shall leave a notice and shall retry the delivery in the next 24 hours.
In case of further absence, the shipment shall be held at the local courier depot and a storage procedure shall be implemented, requiring a timely release with delivery instructions. Alesia srl shall not be held liable in the delay of fulfillment or delivery of merchandise ordered.
INSTRUCTIONS FOR RECEIVING MERCHANDISE
When the courier delivers the merchandise, the customer must verify the integrity of the package and of the custom tape, and ensure that the number of packages indicated is the number of packages actually delivered. Any objections should be immediately raised with the courier, indicating on the delivery document, that the merchandise is accepted with reservations, or that the merchandise has been rejected due to package tampering. An email contesting the delivery must be sent to: email@example.com. Even if the packaging is intact, the merchandise must be verified no later than within eight days of receipt. Any damage or anomalies should be reported to Alesia srl in written form through an email.
SHIPPING COSTS IN ITALY
Free transportation for orders up to 100 euros.
For orders over 100 euros, the charge shall be 9 euros. The shipping costs to the customer shall be notified at the time of the order.
SHIPPING COSTS IN THE EU
Transportation costs may vary depending on the weight and volume of the shipment and the destination location. These shall be determined and provided in the delivery quote.
RETURNS OR EXCHANGES
The customer may contact Customer Service within 14 days of receipt of merchandise in order to return items by choosing the following options:
Items purchased and unworn with all relative labels, tags, original packaging and certificated of guarantee, must be returned at the customers’ expense in a secure package to:

The costs and risks of transport for return are the responsibility of the customer. Items that are returned in poor condition or without all accessories, labels and tags shall not be accepted by Alesia and shall be returned to the sender with increased transports costs.
Items purchased and not used and fully accompanied by all labels, tags, original packaging, and certificated of guarantee, must be returned by the customer in a secure package to:

Upon receipt of the merchandise, Alesia srl shall verify the returned items and reimburse the customer as soon as possible, and within a maximum of 30 days, either by crediting the customer’s Paypal account or by bank transfer. In the case of a bank transfer, the customer must provide wiring instructions in a timely manner in order to receive a refund. In the case of reimbursement due to order cancellation, the amount shall be refunded to the customer’s Paypal account, withholding the relevant 4% service fee charged by Paypal to Alesia. The costs and risks of transport for returns shall be fully borne by the customer. The return of merchandise that is not sanitary, in poor condition, or without the original labels and tags shall not be accepted by Alesia srl and will be returned to the sender with increased transport costs.
Coupons shall be valid for 12 months.
Acquired merchandise that has not been used and fully accompanied by al labels and tags, original packaging and certificate of guarantee, if available, must be returned at the customer’s expense in a secure package to:

Upon receipt of the returned merchandise, Alesia srl will issue a digital voucher of the same value that shall be valid for 12 months from its date of issue. The digital voucher may only be used to purchase items for sale on the website or in the store and may not be converted to cash.
RIGHT OF WITHDRAWAL
As required by Legislative Decree No. 21/2014 in implementation of Directive 2011/83/EU, the customer may exercise the right to withdraw from the purchase contract within 14 days of receipt of the merchandise without penalty, and in compliance with the following point A.
This right shall be exercised by sending, within the agreed upon deadline, an email to the following address: firstname.lastname@example.org, which contains the following information:
- order number and date
- number and date of sales receipt
- any bank details necessary to return payment
Alesia srl will send an email to the customer that contains the form for exercising the right of withdrawal that must be attached to the outside of the package that contains the product. The merchandise purchased – not used and accompanied by the related accessory elements (labels, tags, original packaging, and warranty certificate, if any) – must be returned at the customer’s expense with suitable packaging within 14 days of the receipt of the merchandise to:

Under no circumstances shall packages be collected using Cash on Delivery services, or at the expense of Alesia srl.
Alesia srl will make the refund, minus shipping costs incurred, up to 9 euros, even in the event of free shipping, after receipt of the merchandise and after verifying the condition of the merchandise, within 14 days.
A_The right of withdrawal is subject to the following conditions:
- this right to withdrawal applies to the product purchased in its entirety
- the purchased merchandise must be intact and returned in the original packaging, all part included (to include packaging and any documentation and accessory equipment).
To limit damage to the original packaging, it is recommended, when possible, to place the package inside a second package. In all cases, affixing adhesive labels or tape to the original packaging should be avoided.
- the merchandise subject to the right of withdrawal must be returned in good condition; products that are dirty or show signs of damage shall not be accepted.
- the merchandise subject to the right of refusal must correspond to the merchandise described in the sales document issued by Alesia srl.
- the shipping costs related to the return of the merchandise shall be borne by the customer.
- the shipment, until the time of receipt in our warehouse, shall be the complete responsibility of the customer.
- in the case of damages to the merchandise during transport, Alesia srl will notify the customer of the incident within 5 working days of receipt of the merchandise in its warehouse, to allow the customer to promptly file a complaint against the courier chosen and to obtain a refund of the value of the merchandise (if insured). In this case, the merchandise shall be made available to the customer for its return, at the same time cancelling the withdrawal request. Alesia srl is not liable in any way for damage or theft/loss of merchandise returned through uninsured shipments.
Alesia srl will refund the full amount to the customer in the shortest amount of time possible, at least within 30 days from the date of receipt of the withdrawal notice, upon receipt of the merchandise subject to the withdrawal, through transfer of the amount charged, through Paypal or by bank transfer.
In this case, it will be the responsibility of the customer to promptly provide the bank details in order to obtain a refund (IBAN code). The right of withdrawal shall be null and void if the merchandise is not shipped as instructed. This means; lack of outer packaging and/or the original inner packing
- the absence of all parts and details to include accessories, cables and manuals
- damage to the merchandise for reasons other than transport
- dirty merchandise which has comprised its integrity
All products marketed by Alesia srl are covered by the manufacturer’s conventional warranty and the 24-month warranty for conformity defects, pursuant to DLgs n. 24/02. In order to benefit from warranty assistance, the customer must keep the sales receipt.
The manufacturer’s conventional warranty is provided in the manner described in the documentation inside the product packaging. If, as a result of intervention by an Authorized Service Center, the defect is not covered by the manufacturer’s conventional warranty, the customer shall be charged any verification and restoration costs requested by the Authorized Assistance Center, as well as the costs of transport, if incurred by Alesia srl.
The 24 month warranty pursuant to DLgs No 24/02 applies to the product that does not meet conformity standards, provided that it is used correctly, in compliance with its intended use and the provisions of the attached technical documentation. In case of lack of conformity, Alesia srl shall provide, without charge to the customer, the restoration of the conformity of the product by repair/replacement or the reduction of the price, until the termination of the contract. If, as a result of intervention by an Authorized Service Center, it does not result in the lack of compliance pursuant to DLgs no 24/02, the customer will be charged any verification and restoration costs requested by the Authorized Assistance, as well as the transport costs in incurred by Alesia srl.
In the event, for any reason, Alesia srl is unable to replace a product under warranty (restored or replaced), it may proceed, with the customer’s consent, to replace the product itself (if still listed/available) or with others of equal characteristics and value, or, finally, to issue a discount voucher of the same amount that can be spent on another product, valid for 6 months from the moment of release.
No damage can be requested from Alesia srl for delays in carrying out repairs or replacement of warranty products.
In cases where the application of the guarantees provides for the return of the product, the merchandise must be returned by the customer in the original packaging, complete with all its parts (including packaging and any documentation and ancillary equipment.
In the event that, for any reason, Alesia srl is unable to replace a product under warranty (restored or replaced), it may proceed, with the customer’s consent, to replace the product itself (if still listed/available) or with others of equal characteristics and value or, finally, to issue a discount voucher of the same amount that can be spent on another product valid for 6 months from the moment of release.
No damage can be requested from Alesia srl for any delays in carrying out repairs or replacements or warranty products.
In cases where the application of the guarantee provides for the return of the product, the merchandise must be returned by the customer in the original packaging, complete with packaging and ancillary equipment.

The personal data requested during order processing shall be collected by Alesia srl and processed by computer, I order to meet the obligations arising from the contract concluded with the customer and shall not be transferred under any circumstance and in any capacity to third parties.

The general conditions of sale are drafted and visible in Italian. For the execution, application, and interpretation of the conditions of sale, the Italian language shall be deemed authentic.
JURISDICTION AND APPLICABLE LAW
The sales contract between the customer and Alesia srl is concluded in Italy and regulated by Italian law. For the settlement of civil and criminal disputes arising from the conclusion of this contract, territorial jurisdiction shall be that of the local municipality; in all other cases, the territorial competence is exclusively that of Venice.
